The Importance of Medico-Legal Analysis in Supporting Forensic Expert Reports

Abstract

 Among the functions of the forensic medical expert, within a legal process, is the performance of assessments of living persons at the request of the Judicial Authority. In Costa Rica, such assessment can be carried out both at the Headquarters and at the Forensic Units of the Legal Medicine Department of the Judicial Investigation Agency, as auxiliary bodies of the Administration of Justice. After each forensic medical evaluation, a document is issued, known as the forensic report, which, once transcribed, is sent to the Judicial Authority that has requested it. This opinion must have a substantiation section that includes the forensic analysis to reach the conclusions, so its omission or incorrect performance could cause that within the legal process, the conclusions issued in the expert opinion lose their validity and effectiveness. The objective of this article is through the study of a forensic clinical case, to expose the importance of analyzing in a complete and detailed way the elements of judgment that support the conclusion of a forensic report.
